What is a Litigation Funder? A litigation funder is an unrelated third party who finances some or all of the legal expenses of one or more legal disputes in exchange for a share of the proceeds recovered from the resolution of the dispute(s). Litigation funders typically provide funding on a non-recourse basis, meaning that if there is no recovery made from the dispute(s), then there is no obligation to repay the funder its advances or to pay any return on its investment.

Litigation funders come in all shapes and sizes and can be listed entities, private business or funds. Many of the world’s leading litigation funders are members of the International Legal Finance Association (ILFA) and the Association of Litigation Funders of England and Wales (ALF).
