As a result of The Civil Litigation (Expenses and Group Proceedings)(Scotland) Act 2018 (Success Fee Arrangements) Regulations 2020 coming into force earlier this week, Scotland has taken further steps to promote access to justice. The Regulations mean that Damages-Based Agreements (DBAs) are now available in the armoury of funding tools which Scottish solicitors can offer to their clients.

Woodsford supports this welcome change, giving cash-constrained Scottish claimants another option when looking to pursue meritorious claims.

It is Interesting to see that the approach in Scotland permits hybrid DBAs which are not yet allowed in England & Wales, even though the Law Society of England & Wales supports their adoption. Surely it’s now only a matter of time before hybrid DBAs are allowed in England & Wales, which would be a positive step for access to justice.
